            of Spaine together w<ex>i</ex>th the Popes replies &amp; commands <lb/>
         </head>
         <p>
            <add place="RM">The Replies of the Pope</add>
            The capitulac<ex>i</ex>on of the K:	
         </p>
         <list rend="numbered">
            <item n="1">
               That the mariage is to be made w<ex>i</ex>th the Popes <lb/>
               dispensac<ex>i</ex>on  &amp; t<ex>hat</ex> the dispensac<ex>i</ex>on is to be p<ex>ro</ex>cured <lb/>
               by the K: of Sp: who is to give his <unclear>replies words</unclear> to  <lb/>
               the K: of grt Britt: to doe all possible he cann to <lb/>
               obteyne the dispensac<ex>i</ex>on of the Pope.	
            </item>
            <item n="2">
               <add place="RM">
                  i the mariage ought to be <lb/>
                  celebrated but once and  <lb/>
                  that in Spanie but if anie <lb/>
                  Solempnyty be done in <lb/>
                  Engl: the formes of the <lb/>
                  said Solempnyty is to be <lb/>
                  declared.
               </add>
               That the mariage is to be celebrated in  <lb/>
               Spaine &amp; in England in Sp: accordinges to <lb/>
               the forms of the Church of Rome and in Engl. <lb/>
               w<ex>i</ex>th the cerimonies which shall seeme fittinge <lb/>
               to the C: of Engl: provided that none of the  <lb/>
               said cerimonies be contrarie to the Religion <lb/>
               of the most excellent Infanta but hereof &amp;  <lb/>
               <unclear>forme is</unclear> to be drawne in w<ex>ha</ex>t manner forme <lb/>
               they ought to be done here and there.
            </item>
            <item n="3">
               That the most excellent Infanta shall <lb/>
               alwayes have free use and publiqe excercise <lb/>
               of the Catholicke Relligion in the manner <lb/>
               &amp; formes as is hereafter capitulated
            </item>
            <item n="4">
               That the most excellent Infanta shall <lb/>
               haue <unclear>her</unclear> serv<ex>an</ex>ts and all her famyly chosen &amp; <lb/>
               named by the Ki: of Sp: provided that the <lb/>
               said K: of Sp: name not vassalls of the K: <lb/>
               of grt Britt: w<ex>i</ex>thout his expresse will <lb/>
               and consent.

                  5 That there be <unclear>Bi<ex>sho</ex>pps</unclear> &amp; - / () <lb/>
                  publiqe church at Lond. <lb/>
                  &amp; els where, where the (most) <lb/>
                  excellent Infanta is to <lb/>
                  reside &amp; live &amp; <ex>th</ex>a<ex>t</ex>
                        <hi rend="bold"> </hi>in both (place<supplied reason="damage">s</supplied> <lb/>
                  all divine duties be done <lb/>
                  the word pre<add place="above">a</add>ched and the <lb/>
                  Sacram<ex>en</ex>ts administered.
               </add>
               That the most excellent Infanta shall <lb/>
               haue most convenient places of prayer <lb/>
               in o<ex>u</ex>r Pallace where masse may be said <lb/>
               att her pleasure and that the said place <lb/>
               of prayer may be adorned w<ex>i</ex>th the decency <lb/>
               w<ex>hi</ex>ch shall seeme fittinge to the said excellent <lb/>
               Infanta.

               That in the said place of prayer or chappell <lb/>
               it shalbe p<ex>er</ex>mitted to her <unclear>preists</unclear> to exercise <lb/>
               the free use of theire function in the manner <lb/>
               that the most excellent Infanta shall - - <lb/>
               ordayne.

                  women of the most excellent <lb/>

                  and theire Chillderen and <unclear>(race) </unclear> <lb/>
                  &amp; all her Familiars ought  <lb/>
                  to be freely Catholiqes
               </add>
               That the serv<ex>an</ex>ts both men &amp; women of the <lb/>
               most excellent Infanta &amp; the serv<ex>an</ex>ts of  <lb/>
               her serv<ex>an</ex>ts &amp; the p<ex>er</ex>sones w<ex>hi</ex>ch belonge to <lb/>
               the famyly may be Catholiqes freely <lb/>
               w<ex>hi</ex>ch notw<ex>i</ex>thstandinge ought to be - - <lb/>
               understood soe t<ex>ha</ex>t whosoeu<ex>e</ex>r wilbe a serv<ex>an</ex>t <lb/>
               obleige himselfe as a Catholiqe –  <lb/>
               &amp; serv<ex>an</ex>t

               That the aforesaid serv<ex>an</ex>ts yf they be <lb/>
               Catholiks may be soe in manner full <lb/>
               <unclear>owingd</unclear>
            </item>
            <item n="9">
               That the most excellent Infanta shall <lb/>
               haue in the Court or adioyinnge to the <lb/>
               Court a Chappell soe capacious as all <lb/>
               the said Catholiqe serv<ex>an</ex>ts may enter &amp; bee <lb/>
               conteyned therein, w<ex>hi</ex>ch Chappell is to <lb/>
               haue one publiqe and ordinarie <unclear>dore</unclear> <lb/>
               through which the serv<ex>an</ex>ts may enter and <lb/>
               another inward <unclear>dore</unclear> towarde the Court <lb/>
               through w<ex>hi</ex>ch the said most excellent <lb/>
               Infanta may enter and here masse <lb/>
               and celebrate holy dayes
            </item>

                  10 That the Chappell and <lb/>
                  publique churches <unclear>&amp;c</unclear>
               </add>
               That the Chappell be beautyfied w<ex>i</ex>th the <lb/>
               decent ornam<ex>en</ex>t of the Allter &amp; other <lb/>
               things w<ex>hi</ex>ch are necessarie for devine - - <lb/>
               wor<ex>shi</ex>pp: which is to be celebrated according <lb/>
               to the use of the holy Church of Rome. <lb/>
               And yf it be lawfull for the said serv<ex>an</ex>ts <lb/>
               &amp; others as hath <unclear>bine</unclear> aboue said to goe <lb/>
               to the said Chappell att all <unclear>howers</unclear> that <lb/>
               they will

                  11 The Pope as before <lb/>
                  adds publiqe church
               </add>
               That <ex>th</ex>e care and Custodie of the said <lb/>
               Chappell shalbe com<ex>m</ex>itted to those whom <lb/>
               the most excellent Infanta shall appointe <lb/>
               to whom it shalbe longe (sic) not to suffer any <lb/>
               to enter to doe any vndecent thinge <lb/>
               in the said Chappell -

               That for the administrac<ex>i</ex>on of the Sacram<ex>en</ex>ts        <lb/>
               in the said Chappell there shalbe a number of <lb/>
               ministers as shalbe seene convenient <lb/>
               to the said Infanta and they are to be nomi= <lb break="no"/>
               nated by the said most excellent Infanta <lb/>
               Provided that they be none of the K: of <lb/>
               grt Britt: or if they be it must be w<ex>i</ex>th his <lb/>
               consent &amp; likenige,

                  13 That therbe a minister <lb/>
                  w<ex>hi</ex>ch shalbe indued w<ex>i</ex>th the <lb/>
                  quality of a Bish<ex>o</ex>pp:

               That there be a superior minister <lb/>
               w<ex>i</ex>th sufficient authorities for all causes <lb/>
               w<ex>hi</ex>ch shall happen to touchinge the Catholiqe <lb/>
               Religion

                  14 The Pope adds the <lb/>
                  name of Bishopp:
               </add>
               That this sup<ex>er</ex>ior minister may correct <lb/>
               punishe chastice the Catholiques w<ex>hi</ex>ch shall <lb/>
               offend &amp; excersise uppon them all eccle- <lb/>
               siasticall iurisdicc<ex>i</ex>on nd moreou<ex>e</ex>r that <lb/>
               the most excellent Infanta may dis= <lb break="no"/>
               charge them of her services
            </item>
            <item n="15">
               That the most excellent Infanta <lb/>
               and her serv<ex>an</ex>ts may <sic>lawfullly</sic> <unclear>as</unclear> afore= <lb break="no"/>
               said get from Rome dispensac<ex>i</ex>ons in= <lb break="no"/>
               dulgences Iubiles and all other things <lb/>
               w<ex>hi</ex>ch serve convenient for theire – <lb/>
               consciences.
            </item>
            <item n="16">
               That the serv<ex>an</ex>ts of the most excellent <lb/>
               Infanta take the oath of fidelitie to the <lb/>
               Ki: of Grt Britt: provided there be noe <unclear>cluases</unclear>
                    <hi rend="bold"> <lb/>
               </hi>or word in the said oath w<ex>hi</ex>ch may contradict <lb/>
               the Relligion &amp; conscience of the Catholiqes <lb/>
               &amp; to this purpose the forme of the oath is  <lb/>
               to be approved by the Appostolicke sea
            </item>
            <item n="17">
               <add place="RM">
                  17 That the lawes which doe and <lb/>
                  hereafter shall not meddle w<ex>i</ex>th <lb/>
                  or haue to doe w<ex>i</ex>th the serv<ex>an</ex>ts <lb/>
                  &amp; other laymen aforesaid <lb/>
                  the w<ex>hi</ex>ch shalbe exempted <lb/>
                  from the paine and penaltie <lb/>
                  made against such<del rend="strikethrough">()</del> <lb/>
                  trangressors, but the church <lb/>
                  men shalbe subiect to none but <lb/>
                  the said <unclear>Eccle<ex>sia</ex>sticall</unclear> lawes.
               </add>
               That the lawe of Kings: touching Relligion <lb/>
               shall haue nothinge w<ex>i</ex>th the said Catholicke <lb/>
               serv<ex>an</ex>ts of the most excellent Infanta <lb/>
               w<ex>hi</ex>ch shalbe all exempted from the said lawes <lb/>
               &amp; penallties made against such tra<add place="above">n</add>sgressors: <lb/>
               and it will be needfull to declare how and in <lb/>
               what manner this busines is to be managed

               18	That the chill<add place="above">d</add>eren that shalbe borne <lb/>
               of them during this matrimonie  <lb/>
               shall not be forced or compelled <lb/>
               in matters if Relligion and conscience <lb/>
               and t<ex>ha</ex>t the lawes against Catholickes <lb/>
               shall not extend to them in case <lb/>
               that anie of them be Catholickes <lb/>
               nor for this respect shall they <lb/>
               loose the right to succeed in the <lb/>
               kingdome &amp; dominion of grt Britt:

                  19 That the Nurses Which said give  <lb/>
                  sucke to the childeren of the <lb/>
                  most excellent Infanta be <lb/>
                  Catholickes &amp; that the Infanta <lb/>
                  choose them and that they be <lb/>
                  accompted of her family.

               19	<del rend="strikethrough">That the</del> the Nurses w<ex>hi</ex>ch shall give <lb/>

               excellent Infanta shalbe chosen <lb/>

                  i For security that the marriage <lb/>
                  may not be undon there can be <lb/>
                  noe <unclear>strong<ex>e</ex>r</unclear> obligac<ex>i</ex>on in fealty <lb/>
                  of truth then the Relligions <lb/>
                  and lawe of the kingdom <lb/>
                  both which doe much contradict <lb/>
                  a divorce nor can therebe <lb/>
                  added any other then honor and <lb/>
                  reputac<ex>i</ex>on. Notw<ex>i</ex>thstandinge <lb/>
                  lett euery thinge be done <lb/>
                  that can be done w<ex>i</ex>th decency <lb/>
                  and conveniency.
               </add>
               Though for great security it hath <lb/>
               beene offered that we well the Infanta <lb/>
               as the prtion of her contract of <lb/>
               matrymonie be keepte in Spaine <lb/>
               untill the condic<ex>i</ex>on be p<ex>er</ex>formed. <lb/>
               Notw<ex>i</ex>thstandinge to avoid divorcem<ex>en</ex>t <lb/>
               greater assurances are requisite and <lb/>
               that is desired w<ex>hi</ex>ch may give great <lb/>
               security. And t<ex>ha</ex>t the most excellent <lb/>
               K. of great Britt: declare (w<ex>ha</ex>t) security <lb/>
               shalbe given that in noe case the <lb/>
               marriage once contracted shalbe <lb/>
               dissolved
            </item>

                  <add place="above">2</add> That the Childeren are to remaine <lb/>
                  under the goverm<ex>en</ex>t &amp; care of the <lb/>
                  woman untill the age <unclear>
                            <ex>tha</ex>t is used</unclear> <lb/>
                  in such cases, &amp; this to be confor- <lb/>
                  mable to the complecc<ex>i</ex>on &amp; health <lb/>
                  of the said children w<ex>hi</ex>ch accordingly <lb/>
                  shall remaine a longer or shorter  <lb/>
                  tyme, untill the said goverm<ex>en</ex>t.
               </add>
               That it be declared untill what age <lb/>
               the most excellent Infanta shall  <lb/>
               haue the educac<ex>i</ex>on of the childeren <lb/>
               that shalbe borne of them during <lb/>
               this matrimonie
            </item>

               That it be declared &amp; <unclear>et</unclear>

                  3 The serv<ex>an</ex>ts w<ex>hi</ex>ch shall come from <lb/>
                  Spaine shalbe nominated <lb/>
                  by the Catholiqe K: when= <lb/>
                  soeu<ex>e</ex>r theire place shalbe <lb/>
                  vacant. /

               That it be declared that whensoeu<ex>e</ex>r <lb/>
               the place of the serv<ex>an</ex>ts men &amp; women <lb/>
               that the said excellent Infanta shall <lb/>
               carry w<ex>i</ex>th her shalbe vacant that then <lb/>
               others be named w<ex>i</ex>th the Catho: K: <lb/>
               her brother in theire places eu<ex>e</ex>ry tyme <lb/>
               shalbe vacant either by the death or <lb/>
               dissmission or callinge home the said <lb/>
               officers by his will. /

                  4 For securyty that all t<ex>ha</ex>t be capitulated <lb/>
                  may be accomplished <ex>th</ex>e K: of grt: <lb/>
                  Britt: &amp; the Prince of Wales will <lb/>
                  obleige themselves by oath and – <lb/>
                  seale it w<ex>i</ex>th the grt. seale of Engl: <lb/>
                  and the said K: &amp; Prince of Wales <lb/>
                  will likewise give theire faith &amp; words <lb/>
                  that they will doe all that shalbe possible <lb/>
                  that eu<ex>e</ex>ry that shalbe capitulated may <lb/>
                  be established by p<ex>ar</ex>liam<ex>en</ex>t and because <lb/>
                  noe <unclear>causion</unclear> may be refused, yf the <lb/>
                  K: of Sp: shall add or expound any <lb/>
                  other thinge w<ex>hi</ex>ch may be done w<ex>i</ex>thout <lb/>
                  destroyinge the fittinge <unclear>decorum</unclear> <lb/>
                  the K: of grt Britt: will doe it w<ex>i</ex>th a <lb/>
                  good will. /

               That most excellent K: of – <lb/>
               grt Britt: declare the securyty <lb/>
               which he can give that all that <lb/>
               shall be capitulated shall (be) <lb/>
               keept inviolablely. /

            &amp; synce for grauntinge of a dispensac<ex>i</ex>on other things are required <lb/>
            for the p<ex>ro</ex>ffitt increase and of the Catholicke and Romishe Relligion <lb/>
            the said things are to be p<ex>ro</ex>pounded <unclear>one</unclear> the parte of the kinge <lb/>
            of great Brittayne: to the end that o<ex>u</ex>r holie Father may dele= <lb break="no"/>
            berate whether by the p<ex>er</ex>swac<ex>i</ex>ons of such offers a dispensac<ex>i</ex>on <lb/>
            may be graunted. /
